We have developed the HealthForceGo mobile application which is available for download from the Apple App Store for Apple devices or Google Play for Android devices. The App allows a user to create a profile and book shifts more easily once installed on a user’s device. The App includes a number of features, about which more information can be found in the App Terms and Conditions available in the “My Profile” section of the App (the “Services”). The Services available to you in the App may be limited or restricted depending on your use of the App or by the settings you or we have enabled or disabled within the App.
We take your privacy seriously and are committed to protecting and respecting your personal data. This privacy notice (“Privacy Notice”) sets out the basis on which the personal data collected from you or that you provide to us will be processed by us. This notice supplements the Employee Privacy Notice published in our website. Please read the following carefully to understand how we will use your personal data. For the purpose of data protection legislation in the UK, we are the controller of the personal data collected through your use of the App.

WHAT PERSONAL DATA DO WE COLLECT AND PROCESS, AND HOW DO WE USE IT?
When you use the App, you may provide us with the following personal data, and we may collect and process such personal data in accordance with this Privacy Notice and for the following purposes:

Identity Data: this includes your title, first name, surname and date of birth.

- To provide the live chat feature in the App

- To satisfy our legitimate interests (to run HealthForceGo and our business, to maintain our records, to prevent fraud, to keep you safe, to answer any queries or propose solutions to any problems you are having with the App)
- To comply with a legal obligation
Contact Data: this includes your address, phone number(s), email address and any other contact details. You must ensure that you have obtained the consent of any person you have submitted as your next of kin and/or designated emergency contact as we may also process their personal data.

- To satisfy our legitimate interests (to keep our records up to date and ensure we provide you with relevant information about your Assignments and your availability)
Financial Data: this includes your bank account number and sort code.
- To pay you for the Assignments you have completed
- To refund you for any mileage or expenses you have incurred during your Assignments
- To fulfil our contract with you and pay you for the work you have carried out for us.
Location Data: this includes your precise and approximate geo-location which we collect from the device you use to access the App. You can also upload your location data manually yourself.
- To log when you have checked in and out of complex care Assignments
- To verify the staff who have checked in and out of a Client location
- To verify whether a timesheet has been signed at the Client location
- If you have the Auto-assign feature enabled, to allow nearby and available Assignments to be automatically allocated to you
- To ensure your safety when you are at Client locations
- To fulfil our contract with you.
Profile Data: this includes anything you upload to your Profile on the App including your qualifications education training health data vaccinations background checks hobbies professional registrations and certifications.
- To assess whether you have the relevant qualifications for a particular Assignment
- To enable us and Clients to verify the information that you have provided to us in your Profile on the App
- To satisfy our legitimate interests and those of our Client, who has engaged us to provide services to them (making sure you are suitably qualified for the Assignments allocated to you, ensuring the right people are allocated to the right Clients, ensuring the make-up of our staff is appropriate to the needs of our Client base).
Assignment Data: this includes information about where, when and for whom you have carried out Assignments, ratings and comments you have received, and your completed timesheets and timecards.

- To ensure we pay you for the Assignments you have completed
- To maintain a good and consistent quality in the service we provide to Clients
- To satisfy our legitimate interests (ensuring Assignments are being correctly and fully carried out, paying you promptly and accurately, reviewing comments and ratings provided by Clients).
Diversity Data: we may ask you for more information about your background including your age gender marital status ethnicity sexual orientation disability religion or belief.
- To help us in complying with our legal and regulatory obligations (in particular, with the Equality Act 2010)
- To enable us to be considerate of your needs related to, for example, your religious beliefs
- To help us ensure we are being as fair as possible in our recruitment practices
- Your consent – it is up to you whether you provide us with any of this information and you can delete it from within the App and request that we delete it and stop processing it (see section 8 below) at any time.
Usage and Tracking Data: we may process data regarding your use of the App, including App download and deletion, average time spent in the App, any problems reported, your IP address, device type, and number and frequency of logins.

- To optimise the performance of the App to ensure you have the best user experience
- To monitor your performance at work and ensure you are using the App in compliance with our BYOD Policy
- To satisfy our legitimate interest (to enable you to use the App most effectively, improve the usability of the App and make any necessary modifications and updates to the App).
App Notification Data: this includes your assignment data, profile data.
- To help you manage your professional qualifications, certifications and legal status
- To help you manage your schedule
- Your consent – it is up to you to allow it in your device. To withdraw consent, you need to change the app settings in your device.

WHO DO WE SHARE YOUR PERSONAL DATA WITH?
By using the App, we may need to disclose your personal data to selected third parties in the following limited circumstances:
- We share your personal data with third party service providers such as Amazon Web Services (who hosts Health Force infrastructure), Intercom, (Intercom provides analytics services and the functionality for the live chat feature on the App), Firebase (for tracking events, for use of Firebase Crash Reporting, Google Analytics and Dynamic Links), Pendo (for user behavioural analytics), Google Maps, Apple Maps, Apple Push Notification Service, Firebase Cloud Messaging (FCM), Futuru Learning Management System, ZohoForms (that handle Health declaration).
- We share your personal data with other Organizations including our third-party data processors, our Clients and their third-party data processors etc. This aspect is more fully described in our Employee Privacy Notice.

TRANSFERS OF YOUR PERSONAL DATA
We will not transfer your personal data outside of the UK, except to selected third parties that we have instructed to help us provide the App to you, and such third parties may process and store your personal data in any one of their geographically distributed data centres as part of its cloud platform.
In the case of transfers of your personal data outside of the UK, where the transfers are not to countries that provide an adequate level of protection (for example, we may rely on Data Privacy Framework where the transfer contains a US entity), we will use reasonable efforts to put in place appropriate safeguards to cover transfers of your personal data which may include, for example, signing UK International Data Transfer Agreement (IDTA) adopted by the UK Information Commissioner’s Office (ICO). AUTOMATED DECISION MAKING AND PROFILING
Newcross Healthcare performs auto allocation of staff to client booking based on algorithm that matches staff’s work preferences, client’s preferences, named individual exclusions, staff pullouts, clients’ job needs (including gender) with staff’s profile, skills and availability.
Newcross Healthcare uses bots in its contact centre to respond to your queries and to perform initial triaging on routing your requests to appropriate contacts within the contact centre.
Profiling is undertaken through the use of analytics in pursuance of our legitimate interests.

ACCESSING YOUR PERSONAL DATA AND YOUR RIGHTS
As a result of us collecting and processing your personal data, you have the following legal rights
- to access personal data held about you;
- to request us to make any changes to your personal data if it is inaccurate or incomplete;
- to request your personal data is erased where we do not have a compelling reason to continue to process such data in certain circumstances;
- to receive your personal data provided to us as a data controller in a structured, commonly used and machine-readable format where our processing of the data is carried out by automated means, and it is based on: (i) your consent; (ii) our necessity for performance of a contract to which you are a party to; or (iii) steps taken at your request prior to entering into a contract with us;

- if we ever use your personal data for direct marketing, you can ask us to stop and we will comply with your request;
